Works Council (Betriebsrat)

The elected employee body in German companies whose co-determination rights cover any system capable of monitoring staff performance.

[01]What It Means

Under the Works Constitution Act the council must be informed and must approve technical systems that can measure behaviour or performance – which includes CRM analytics, conversation intelligence and AI coaching tools. Approval is usually formalised in a works agreement that limits how the data may be used.

[02]Why It Matters

This is where GTM technology projects stall in DACH, long after IT and legal have signed off. Recording bots that join customer calls are frequently rejected outright, and individual leaderboards are often disabled in favour of team-level reporting.
