TDDDG (Germany) and Tracking Consent

The German implementation of the ePrivacy rules requiring prior consent before anything is stored on or read from a user’s device.

Section 25 covers cookies, fingerprinting and tracking pixels, business context included. Because consent cannot be obtained before a cold email is sent, open and click tracking on cold outreach to German recipients has no lawful basis, and teams selling into Germany routinely disable it.

It changes how performance is measured. Without opens and clicks, campaign quality is judged on replies, answer rate and meetings – which is a healthier standard, but only if the reporting model is rebuilt rather than left blind.
